Terms of service
Clear rules for shopping with Ettch, protecting the store and resolving problems fairly. The sales provisions below are proposed for launch.
Proposed launch policy. Live orders are closed. Business mailing details, shipping rates and supported delivery estimates must be completed before sales open. Sandbox orders do not ship or transfer real funds.
1. Ettch and these terms
Ettch is a California-based clothing brand operated as a sole proprietorship, not an LLC. “Ettch,” “we,” “us” and “our” mean the seller operating this brand. Contact support@ettch.store for questions. The seller's full legal identity and appropriate business mailing address will be supplied before live sales open; we do not publish a personal home address in this preview. The linked Shipping, Returns & refunds and Privacy policies explain the corresponding practices.
2. Preview and eligibility
Only sandbox transactions are currently accepted: no real funds transfer, test stock is not physical inventory, and test orders are not fulfilled. Do not expect delivery from a test order. To make a real purchase, you must be at least 18 or have the authority and supervision needed for a valid agreement. Supply truthful details and an authorized payment method. Guest checkout is available; an account is optional.
3. Products, availability and pricing
Prices are in US dollars and include mandatory merchant fees. Applicable government taxes and disclosed shipping charges are shown separately before payment. Screen colors and measurements can have reasonable variations, without excusing materially misdescribed goods. Current artwork, sample prices and stock are still being finalized. We may change prices, promotions and availability for future orders. We do not increase the price of an accepted order without express agreement. Discounts apply under their disclosed conditions.
4. Errors and purchase limits
If a material price, description or stock error affects a proposed order, we will notify you before acceptance and offer corrected terms or cancellation. We do not silently charge more or substitute items. If payment was collected and an order cannot be fulfilled as agreed, we promptly refund it unless you expressly choose an alternative. We may set reasonable purchase limits, check suspected fraud or decline an order for lawful reasons. Relevant limits will be disclosed; they do not permit unlawful discrimination or removal of mandatory remedies.
5. Payment and order acceptance
Checkout shows the final total before authorization. Stripe supplies the enabled, eligible methods displayed, which may include cards, digital wallets or installment providers; no particular method is guaranteed for every customer. Clothing purchases are one-time purchases, not subscriptions. Payment is taken during checkout or under the selected provider's disclosed schedule. Placing an order or receiving a payment-processing acknowledgement alone is not acceptance. An order is accepted when our system verifies payment and shows a paid order confirmation. A pending, processing or review status is not confirmation; do not assume it will ship.
6. Providers and stock reservations
A bag does not guarantee stock. Checkout temporarily reserves available units and can expire if not completed. Payment is verified on the server, not solely from the return page. Wallet or installment providers set their own eligibility, repayment, interest and fee terms; review these before selecting them. Refunds use the original payment route. Required consumer and payment-dispute rights remain available.
7. Shipping and delivery problems
The launch plans US delivery from inventory held by Ettch, with no current preorders. Services, postage and supported dispatch/delivery estimates must be disclosed before a live purchase. Shipping explains tracking, address corrections and missing/damaged parcels. If dispatch cannot occur as promised, we notify you, obtain agreement to a delay when required, or cancel and promptly refund. Carrier delays do not excuse statutory duties. Shipping-loss responsibility follows applicable law and circumstances rather than a blanket transfer to the customer.
8. Returns and product rights
Our proposed change-of-mind window is 30 days after delivery for unworn, unwashed, unaltered items with tags attached. Customers pay ordinary change-of-mind return postage; Ettch covers reasonable postage for defective, damaged or incorrect items. There is no restocking fee. Returns & refunds explains requests, inspection, shipping-charge treatment and the original-payment-method refund process. These conditions do not waive implied warranties, rights for misdescribed or defective goods, or other mandatory remedies.
9. Accounts and acceptable use
Keep your password confidential and promptly report suspected unauthorized access. Do not impersonate others, use stolen payment details, submit fraudulent orders/refund claims, deploy malicious code, bypass access controls, interfere with stock systems, or harass people through the store. You are responsible for conduct you authorize, without losing rights concerning unauthorized payments. We may reasonably restrict access to investigate abuse or protect security; this does not cancel legitimate order or refund rights.
10. Intellectual property and reviews
Ettch branding, product materials, original text and original code belong to Ettch or its licensors to the extent they hold the relevant rights. Third-party software, fonts and materials retain their own licenses. Personal shopping use is allowed; copying or commercially exploiting protected materials requires permission or another lawful basis. You retain ownership of your honest review and give Ettch nonexclusive permission to display it on the storefront and moderate it under the published rules. You may request removal. We do not prohibit or penalize honest negative reviews.
11. Availability and warranties
We aim to keep the store reliable but cannot promise uninterrupted access, an error-free website or compatibility with every device. Maintenance or security may require a pause. General site information does not replace confirmed product descriptions or express promises for an accepted order. These terms do not impose a blanket 'as is' disclaimer on consumer goods or exclude warranties and remedies that cannot legally be excluded.
12. Limits on liability
Only to the extent permitted by applicable law, Ettch is not responsible for indirect, incidental, special or consequential economic losses, such as lost profits, arising from website use. For ordinary economic claims concerning a purchase, total liability is limited to the amount paid for the affected order, where enforceable. These limits do not restrict required refunds, nonwaivable warranties, statutory remedies, or liability for fraud, willful misconduct, gross negligence, unlawful conduct, death or personal injury, or anything else the law does not permit us to limit. A limitation applies only where lawful and does not replace a mandatory remedy.
13. Misuse and external services
To the extent permitted by law, you remain responsible for direct losses caused by your intentional fraud or unlawful interference with the store. Ordinary shopping, good-faith complaints and honest reviews do not require reimbursement of Ettch. External sites and payment services have separate terms; linking them does not mean we control all their practices or remove our obligations as seller.
14. Governing law and disputes
California law and applicable US federal law govern these terms, subject to mandatory consumer protections where you live. Contact support@ettch.store for help resolving a problem, but contacting us is not a condition for exercising a legal right. These terms do not impose mandatory arbitration, waive jury or class-action rights, prevent small-claims filings, or remove a legally required forum. If a provision is unenforceable, remaining provisions continue to the extent lawful.
15. Updates and communications
We may update these terms for future use and purchases by posting a dated revision. Material changes will be highlighted on the store and, where appropriate, communicated directly to affected customers. We seek consent when required. The sales terms supplied when an accepted order is placed continue to govern that order unless a change is required by law or agreed by you. Later revisions do not retroactively remove refund, warranty or dispute rights. Keep a copy of your terms and confirmation.
